Dealer Fraud: Crooked Games Dealers Play

Dealer fraud comes in many varieties. I’m pursuing several case regarding promotional contest mailers that dealers send out to past and prospective customers. Often the mailers promise and assortment of prizes, including large sums of money, MP3 players, and flat-screen TVs.

The contest mailers usually take the form of a type of instant lottery card. You scratch off an area then match it with the prize numbers. Then you’re usually directed to call a specific number to confirm your prize. Then you’re directed to come to the dealership to claim your prize.

According to the law, no purchase may be made necessary for the receipt of the prize. But once you arrive at the dealer, the prize awarding mailer is taken from you never to be returned and you are subjected to a hard sell.

The salesperson avoids the subject of your prize, makes up an excuse for your non-eligibility, or tricks you into thinking the prize has been converted into a down-payment or other favorable treatment in the sale.

Make a copy of your complete contest mailer before you go to the dealer. Insist on receiving your prize before you engage in any discussion regarding a purchase.

If the dealer will not give you your prize, then insist that the dealer give you a full explanation why you are not being given the prize in writing. And that the dealer reference specifically any language in the mailer that supports the dealer’s position.

If the dealer will still not give you your prize, then contact a qualified attorney immediately.
